Om Space Sdn. Bhd including its business unit and/or brand name known as “Om Space Academy” (Hereinafter collectively referred to as “OM SPACE”) operates an life education platform, which mainly helps people to grow and achieve success in seven aspects of life; including personal physical and spiritual success, financial and wealth, relationship and marriage, career, family relationship, physical and mental health and interpersonal communication.

At OM SPACE, we want our customers to be satisfied with the services offered by us. As such, OM SPACE recommends and advises our customers to read and understand the terms and conditions of this Om Space Academy Courses and Programme Policy (“this Policy”) prior to the signing of the Course Registration Form (“Enrollment Form”) pertaining to subscription and participation in the courses and/or programmes from Om Space Academy (“the Course”).

This Policy is divided into a few sections and the customers, wherever are required, shall fill in the relevant details at the space provided and thereafter sign this Policy accordingly. Please note that this Policy shall read together with Course Rules and Regulations (课程规则与制度) which customers may access to https://www.omspace2u.com/info/course-rules-and-regulations/ and the provisions thereof may be varied, modified and/or updated from time to time as OM SPACE deems fit to its current practice (“Course Rules and Regulations”)

1. COOLING OFF PERIOD & VALIDITY
1.1 COOLING OFF PERIOD
Within Five (5) working days upon signing of the Enrollment Form, in the event you shall no longer desirous to participate the Course, you shall notify us by delivering or sending (including by way of electronic mail) a written cancellation notice to us (hereinafter referred to as “Cancellation Notice”). OM SPACE will refund to you all monies or part thereof which you have paid in respect of the Course (subject to deduction of administrative cost in OM SPACE’s sole and absolute discretion, bank charges (if any) and Sales & Services Tax (“SST”), free of interest, within Thirty (30) business days from the date OM SPACE is in receipt of such Cancellation Notice.

1.2 VALIDITY
1.2.1 All the Course subscribed shall only valid for Eighteen (18) months period only from the date of the enrollment (“Validity Period”) and customers shall attend, utilize and/or complete the Course duly subscribed within the Validity Period. Upon the expiration of the Validity Period, all the unutilized credit(s), session(s) and/or seminar(s) in respect of the Course shall no longer be available and/or valid. For the avoidance of doubt, customers shall not have any claim for refund in respect of any unutilized credit(s), session(s) and/or seminars in respect of the Course upon expiry of the Validity Period.

1.2.2 Notwithstanding the above, customers may extend or defer the Course beyond the Validity Period in which a deferment fee in the sum of RM100/month is payable to OM SPACE.

1.2.3 For the avoidance of doubt, any outstanding in relation to the Course remains unpaid by the customer (if any) shall immediately become due and payable in 12 months from date of enrollment (unless reschedule or otherwise agree by OM SPACE), failing which, late payment interest at the rate of one point five per centum (1.5%) per month shall be chargeable on the outstanding amount due until they are finally paid.

2. TRANSFER, CHANGES, CANCELLATION & REFUND POLICY
2.1 TRANSFER
2.1.1 In the event that you wish to transfer between the Course for any reasons whatsoever, you may transfer the Course between any other course at Om Space Academy at least 14 working days before the commencement of the Course. Please take note that an administration fee of RM100.00 for transferring between course shall be imposed by OM SPACE. You are required to make payment in full for price difference between the Course. There should be no refund for price difference if the selected Course price is lower than your registered Course.
2.1.2 In the event that you are unable to attend the Course for any reasons whatsoever, you may transfer to your nominee provided always that you shall serve a written notice to us together with the full contact details of your nominee, at least 14 working days before the commencement of the Course. Please take note that an administration fee of RM100.00 for transferring to your nominee shall be imposed by OM SPACE.
2.1.3 There should be no transfer between Course and transfer to any nominee allowed for Professional Programme. In the event that you are unable to continue the Course in Professional Programme for any reasons whatsoever, you shall serve a written notice of Programme Deferment or Programme Withdrawal which deem fits to your situation.

2.2 CHANGES OF TIME & VENUE
2.2.1 You hereby agree that OM SPACE reserves the right to change the date, time, venue and/or substitute any speaker(s) in respect of the Course. OM SPACE will notify you in writing of the changes made and you shall not be entitled to request for any refund or any cost, expenses, losses, damages or liabilities which may be incurred or suffered by you as a result of such changes made.
2.2.2 You shall ensure to furnish us with your accurate contact details in the Enrollment Form including your valid email address. We shall not be responsible and/or liable for any delay and/or failure to notify you on any changes on the date, time, venue and/or substitution of any speaker(s) due to the incorrect contact details and email address provided by you to us.

2.3 CANCELLATION
2.3.1 You agree and understand that OM SPACE may cancel, terminate and/or suspend the Course at any time for any reason whatsoever by delivering a written notice to you via electronic mail or courier. You hereby agree that in the event OM SPACE has decided to cancel and/or suspend the Course, you shall only be entitled to a refund of the payment pertaining to the Course (subject to deduction of administrative cost in OM SPACE and/or OM SPACE’s sole and absolute discretion subject to the deduction of administrative charges, bank charges (if any) and SST), free of any interest.
2.3.2 You irrevocably agree that you shall not be entitled to claim any compensation or damages suffered by you as a result of such cancellation, termination and/or suspension.
2.3.3 You further agree and acknowledge that OM SPACE and/or Om Space Academy shall have no further liability to you in respect of the cancellation, termination and/or suspension of the Course.

2.4 REFUND
2.4.1 Customers shall not request or claim for a refund of the Course fees upon expiry of Cooling Off Period. Any request for refund of the Course fee or cancellation of the Course after the Cooling Off Period and within One (1) month from the date of signing of this Policy, shall be subject to the sole discretion and approval of OM SPACE.
2.4.2 Should OM SPACE accede to your request on the cancellation or termination with the period as stipulated in clause 2.4.1 above, you shall be charged a cancellation fee amounting to Twenty-Five per centum (25%) of the Course fee.
2.4.3 Subject to the approval of OM SPACE in its sole discretion, customers shall only entitle to a refund of fifty percent (50%) of the Course fee subject to the deduction of administrative charges, bank charges (if any) and SST from the Course fee if the customers insist for a refund of the Course fee and/or cancellation of the Course after One (1) month from the date of signing of this Policy.
2.4.4 It is to be highlighted that as follows:-
a) No refunds of the Course fee or any part thereof due to cancellation or termination by you shall be allowed after 6 months from the date of the Enrollment Form in respect of the Course or the Policy, whichever is the later.
b) In the event any deposit has been collected in respect of the Course, deposit of less than or equivalent to RM1000 will not be refunded. Instead, it will be credited for further courses offered by OM SPACE.
c) For the avoided of doubt, OM SPACE shall not refund any sums to you as a result of your late arrival to, non-attendance of or withdrawal from the Course.

3. INTELLECTUAL PROPERTY
3.3 At all material times, OM SPACE shall have all the right, title and interest in all intellectual property which shall inclusive of all materials used or delivered to you following the Course (subject to the copyrights of the presenters and/or speakers) and all intellectual property which we may develop as a result of the Course.
3.4 The titles in any intellectual property and title to all such intellectual property shall always remain with us.
3.5 Customers shall only be granted a personal, non-exclusive, non-transferable, non-sublicensable, recoverable, license to use the materials provided by us to you in relation to the Course (“Materials") strictly for personal non-commercial purpose only. Any other use or exploitation of the material is strictly prohibited and may result in criminal or civil action.
3.6 Customers shall not in any manner whatsoever:-
a. Alter any of our intellectual property or the Materials; and/or
b. Use any recording device or record the Seminar and Workshop; and/or
c. Sell the intellectual property or Material (“IP”) or supply the IP to any other third party.

4. CONSENT AND RELEASE OF THE PHOTOS, VIDEOS, RECORDINGS AND STATEMENTS
4.1 By signing up the Course, you are required to submit the Consent and Release of the Photos, Videos, Recordings and Statements prepared by OM SPACE (“Consent and Release Form”) in Enrollment Form.
4.2 The agreement of this clause is optional and subject to your consent and permission. By agreeing to the Consent and Release Form, you understand that the Materials may be used for commercial and/or non-commercial purposes including but not limited to education, training and consultation activities, marketing and promotion of the therapy and consultation practice.
4.3 You understand that the Materials may be edited, copied, exhibited, published and/or distributed. You understand the Materials may be used individually or in conjunction with other media in any medium, including without limitation to print publications, digital publications, and/or public broadcast for any lawful purpose within the nature of business of OM SPACE. There is no time limit on the validity of release nor are there any geographic limitations on where the Materials may be distributed.
4.4 Your participation is voluntary and that you may, at any time, discontinue your involvement in the Course subject to the applicable provisions in this Policy.
4.5 You understand that you shall take full responsibility for your subscription and/or participation in the Course and you shall release OM SPACE from any claims, demands, losses, damages, suits, and liabilities of any kind whatsoever in connection with the foregoing.

5. HEALTH DECLARATION
5.1 Prior to the signing up of the Course or commencement of the Course (as the case maybe), customers shall complete and submit the health declaration form prepared by OM SPACE (“Health Declaration Form”). The purpose of the Health Declaration is to ensure that you are medically and mentally fit to join the Course. In any event that you were diagnosed physically, mentally unhealthy and/or unfit, you must seek medical assistance prior to participating the Course and OM SPACE shall request for a copy of the medical and/or specialist report prior to granting the permission for you to attend the Course.
5.2 You shall ensure that the information declared in the Health Declaration Form are accurate and to the best of your knowledge. You shall accept any responsibility for any omissions in disclosing your existing or past physical and/or mental health conditions.
5.3 The declaration in the Health Declaration Form shall include the following:-
a. Customer(s) are physically and/or mentally sound and/or fit to attend the Course;
b. Customer(s) have not taken up any hazardous occupation neither Customer(s)have suffered any illness /disease requiring treatment for more than one (1) week;
c. Customer(s) will declare his or her mental and physical health situation immediately to Om Space if any of your mental and physical health issues were diagnosed after signing of the Health Declaration Form;
d. Customer(s) will not cause any violence, trouble and/or any form of chaos during the participation of the Course; and
e. Customer(s) shall withdraw or Om Space shall be authorized to withdraw and/or stop customer(s)’ participation in the Course immediately if customer(s) were diagnosed as physically and/or mentally unfit and you understand that all fees and/or payment paid by the Customer(s) and/or his or her legal guardian (as the case maybe) shall not be refundable.
5.4 In the event any unforeseeable situation or incident occurred during the Course due to your unstable physical or mental state, OM SPACE has the right to refuse and/or deny your participation in the Course;
5.5 OM SPACE will not and shall not guarantee any positive and success result from the Course that you have attended and the result shall be depending on your own involvement, attitude, willingness to participate and other positive deeds that shall be maintained by yourself during the participation during the Course.
5.6 OM SPACE shall not be liable for any violence and/or trouble and/or chaos during the Course that caused by unhealthy mental state of customers and/or other participants.

6. PERSONAL BELONGINGS
6.1 All of the customers are expected to be responsible for their own personal safety and their belongings.
6.2 OM SPACE shall only intervene to the extend to ensure that personal belongings comply with access and safety measures.
6.3 Any item may be disallowed if OM SPACE determines it as a potential health or safety risk for OM SPACE’s staffs or other customers.
6.4 Lost and Found Procedures:
a) OM SPACE shall not be responsible for the safety of personal items brought into the OM SPACE’s building. You are expected to maintain your belongings and keep them within your sight. This includes valuables such as wallets, purses, cell phones, and laptops.
b) All found property will be logged and stored by OM SPACE’s Administration Department. A reasonable attempt will be made to return lost property to the proper owner. After a specified time if the item remains uncollected or unidentifiable, all items will be donated or destroyed, as OM SPACE deems fit, without further notice.
c) High value items, such as wallets, cell phones, and legal documents, will be retained for thirty (30) days.
d) Items identified as trash, hazardous, or perishable will not be stored and will be disposed of immediately.

7. SAFETY
7.1 You understand and agree that participation in the Course carries with it the risk to you of personal or bodily injury (including death) and loss or damage to property, and you shall accept that risk. You agree that OM SPACE does not and will not guarantee your safety during your participation in the Course.
7.2 You shall release, relieve, indemnify and forever discharge OM SPACE, its employees, agents, officers, trustees and representatives (in their official and individual capacities) from any and all liability whatsoever for any personal or bodily injury (including death) and loss of or damage to property that I may sustain, including but not limited to any claims, demands, actions, causes of action, judgments, damages, expenses and costs, which arise out of, result from, occur during or are connected in any manner with your participation in the Course, except such liability arising directly and solely from gross negligence on the part of OM SPACE.

8. LIMITATION OF LIABILITY & INDEMNIFICATION
8.1 At all material time, you agree and consent that OM SPACE shall:-
a. limit our liability to you for any claim (whether arising in contract, tort or statute) for any loss or damage whatsoever suffered by you in relation to providing the opportunity to you to subscribe and/or participate the Course to the total amount actually paid by you; and/or
b. exclude all liability for consequential damage (including but not limited to, loss of revenue or loss of profit) suffered by you in any way relating to the revision of the opportunity for you to subscribe and/or participate the Course or your exercise of rights under this Policy and/or the Enrollment Form in respect of the Course; and/or
c. not be liable to you for any loss of profits, loss of revenue or income, loss of business, loss of reputation depletion of goodwill and/or similar losses, loss of anticipated savings, loss of opportunity, loss of use, whether or not the type of loss was foreseen or reasonably foreseeable; or any special, indirect or consequential loss, costs, damages, charges or expenses suffered by you.
8.2 You agree to accept full responsibility of your subscription, participation and/or the outcome of any decision made after attending the Course. OM SPACE and its affiliated entities, associates and any or representatives accept neither responsibility nor will it indemnify you for any and all costs, expenses, losses, damages, liabilities, which may be incurred or suffered by as result of these decisions.
8.3 You agree that any subscription and participation of the Course’ decisions are not influenced by any prior relationship or dealing with OM SPACE or any of its officer, directors, employees or representatives. Should you enter into a contractual relationship with any trainer(s) and/or any OM SPACE’s representative(s) at/or subsequent to the event, you do so at your own risk, and acknowledge that OM SPACE has neither responsibility for, not liability with regards to, any contracts or relationship entered into between yourself and the trainer(s) and/or OM SPACE’s representative(s).
8.4 You acknowledge and agree that OM SPACE assumes no responsibility for the accuracy or appropriateness of any information provided by the speaker(s) at the Course.

9. FORCE MAJEURE
9.1 If the provision of Course are prevented or cancelled because of an Act of God, Inevitable accident, fire, blackout, flood, or any other calamity, or if by reason of riots, strikes or lockouts, or any other events beyond the direct control of OM SPACE, OM SPACE may at its option postpone the delivery of the Course from the original schedule and you shall not be entitled to claim for a refund or for any costs, expenses, losses damages or liabilities which may be incurred or suffered by you as a result of such postponement.

10. GENERAL
10.1 You shall provide accurate, current and complete information as may be required in the for the subscription and/or participation the Course (hereinafter collectively referred to as “Client’s Details”). You shall maintain and update Client’s Details as required to keep it accurate, current and complete.
10.2 You agree and consent that OM SPACE may store and use the Client’s Details (including payment card information) for use in maintaining your account.
10.3 All notice or other communications must be made to the addresses or email address as specified in the Enrollment Form.
10.4 Any notice or request deemed necessary to be served by either party hereto to the other under the provisions of this Policy shall be in writing and shall be deemed to be sufficiently served:-
a. If it is given by either party by prepaid registered post addressed to the other party to be served at his/her/their address hereinbefore mentioned; or
b. If it is given by either party and dispatched by hand to the party to be served; or
c. If it is given by emails by either party, when the sender’s email system confirming successful transmission of such notice.
10.5 Non-exercise of or delay in exercising any power or right of a party does not operate as waiver of that power or right, nor does any single exercise of any power right preclude any other or further exercise of it or the exercise of any power or right. A power or right may only be waived in writing, signed by party to be bound by the waived.
10.6 Any provision in this Policy which is invalid or unenforceable in any jurisdiction, if possible, so as to be valid and enforceable, and is otherwise capable of being severed to the extent of the validity or enforceability, without affecting the validity or enforceable of that provision in any other.

11. ACKNOWLEDGEMENT
11.1 You certify that you are above eighteen (18) years of age and are competent to contract in your own name in so far as the above is concerned. If you are below eighteen (18) years old, your parents or legal guardians have read this document and have given their consent by signing below.
11.2 By signing up the Course and/or signing of this Policy, you acknowledge that you have completely read and fully understand this Policy, Course Rules and Regulations and any other applicable policies issued by OM SPACE and the consequences by accepting the same and are agreeable to be bound thereby.
11.3 OM SPACE reserves the rights to change, modify, amend and/or alter any terms and conditions of this Policy herein, Course Rules and Regulations and any additional policies issued by OM SPACE at any time without giving prior notice to you as the customer.

Kindly read and understand this declaration statement prior to signing it. You must complete this health declaration form to subscribe our online course(s), workshop(s), programme(s) and/or any other products, services and/or packages provided by OM SPACE (“the Courses”). If you are a minor, you must have this declaration signed by your parents or legal guardian.

The purpose of this Health Declaration is to ensure that you are medically fit to join any of our Courses. In any event that you were diagnosed physically and/or mentally unhealthy and/or unfit, it is advisable that you must seek medical assistance prior to participating the Courses and we shall request for a copy of the medical and/or specialist report prior to granting the permission for you to attend the Courses.

I hereby declare and agree that on the day of signing of this declaration:-
1. I am physically and/or mentally sound and/or fit to attend the Courses;
2. I have not taken up any hazardous occupation neither I have suffered any illness / disease requiring treatment for more than one (1) week;
3. I will declare my mental and physical health situation immediately to Om Space if any of my mental and physical health issues were diagnosed after signing of this Health declaration;
4. I will not cause any violence, trouble and/or any form of chaos during the participation of the Courses; and
5. I shall withdraw or OM SPACE shall be authorized to withdraw and/or stop my participation in the Courses immediately if I were diagnosed as physically and/or mentally unfit and I understand that all fees and/or payment paid by me or my parents or my legal guardian (as the case maybe) shall not be refundable.

I hereby understand and acknowledge that:-
1. In the event any unforeseeable situation or incident occurred during the Courses due to my unstable physical or mental state, I agree that OM SPACE has the right to refuse and/or deny my participation in the Courses;
2. OM SPACE will not and shall not guarantee any positive and success result from the Courses that I have attended and the result shall be depending on my own involvement, attitude, willingness to participate and other positive deeds that shall be maintained by myself during the participation during the Courses;
3. OM SPACE shall not be liable for any violence and/or trouble and/or chaos during the Courses that caused by unhealthy mental state of me and/or other participants.

I declare that the information provided herein above is accurate and to the best of my knowledge. I agree to accept any responsibility for any omissions in disclosing my existing or past physical and/or mental health conditions.

I further state that I have duly read and understand this Health Declaration Form and the consequences by accepting the same and agree to be bound by the terms herein.
